Terms of Use

1. Acceptance

By using GearSmith (the "Service") you agree to these Terms of Use. If you do not agree, do not use the Service.

2. What GearSmith is

GearSmith is a browser-based parametric gearbox design tool. It generates gear geometry, simulations, torque and speed estimates, manufacturing files (STEP, STL), bills of materials, and assembly documentation from parameters you choose.

3. Your designs are yours

You own the designs you create and the files you export. Harbegold LLC claims no rights over your generated geometry, and you may use exported files for personal or commercial purposes without restriction or attribution.

4. Engineering disclaimer — read this one

The Service produces engineering estimates, not certified engineering. Torque ratings, efficiency figures, stress calculations, fits, and tolerances are computed from simplified models (e.g., Lewis bending approximations and assumed load-sharing factors) and typical material properties. Real-world performance depends on your printer or machine shop, materials, environment, lubrication, duty cycle, and assembly quality. You are solely responsible for validating any design before relying on it — especially in applications where failure could cause injury, property damage, or financial loss. Do not use generated designs in safety-critical systems (medical devices, vehicles, lifting equipment, aerospace) without independent qualified engineering review.

5. Acceptable use

You agree not to misuse the Service — including attempting to disrupt it, scrape it at abusive volume, or misrepresent its outputs as certified by Harbegold LLC.

6. No warranty

THE SERVICE AND ALL GENERATED FILES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HARBEGOLD LLC DOES NOT WARRANT THAT OUTPUTS ARE ACCURATE, COMPLETE, OR SUITABLE FOR MANUFACTURE.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBEGOLD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM USE OF THE SERVICE OR RELIANCE ON ITS OUTPUTS. IN ALL CASES, HARBEGOLD LLC'S AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM (CURRENTLY ZERO FOR THE FREE SERVICE).

8. Changes to the Service and these Terms

The Service is under active development; features may change or be discontinued at any time. Updated Terms will be posted here with a revised effective date; continued use constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law principles.
